1.  CONTEXT

The Hanns Seidel Foundation is a political foundation with its headquarters in Munich (Germany). “In the service of democracy, peace and development” – this motto is present in the work and mission of the Hanns Seidel Foundation. This motto applies both to its activities in Germany and abroad. Since 1995, HSF has supported the integration of Vietnam into the global political spectrum and the ASEAN-Community. Since the establishment of a representative office in 2011, HSF has focused its work in Vietnam on social and environmental policies for sustainable development.
 
Among the long-standing partners of HSF is the Institute of Strategy and Policies on Natural Resources and Environment (ISPONRE), the think-tank under the Ministry of Natural Resources and Environment (MoNRE) of the Socialist Republic of Vietnam. As the key policy advisory agency to the Ministry, ISPONRE has been assigned to be responsible for several topics in the Guiding decree to the Law on Environmental Protection 2020 including the regulations on developing the environmental industry.
The environmental industry is an integral part of the Vietnam’s sectoral economic system and will be crucial in the process of making production patterns and service delivery in Vietnam more sustainable. The environmental industry of Vietnam has an average annual growth rate of over 15% due to the high demand for pollution treatment and environmental equipment in the context of continuous economic growth. In Febuary 2017, the Prime Minister issued Decision No. 192/QD-TTg on “A scheme for developing Vietnam’s environment industry by 2025”. Most recently, Article 143 of the Law on Environmental Protection 2020 sets out the government’s commitment to invest in and adopt policies to support the development of the environmental industry.
 
To support ISPONRE in drafting the detailed regulation on environmental industry in the decree to the Law on Environmental Protection 2020, HSF and ISPONRE have agreed to jointly identify ONE international expert. The International expert will work closely with two national experts (to be identified in a separate ToR) and ISPONRE research teams to produce a background research paper and to propose the regulations on environmental industry on the Guiding Decree to the Law on Environmental Protection 2020.
 

2.  OBJECTIVE(S)

The objectives of this assignment are as follows:
  • Cooperate with ISPONRE and two national experts to provide technical expertise and international best practices on environmental industry
  • Mainstream international experience in developing policies on environmental industry and point out lesson learnt and suggestions for Vietnam’s policies on the development of environmental industry; the policy of opening the market for environmental goods in trade agreements and a list of environmental
  • Review and propose amendments and recommendations to provisions on the development of the environmental industry sector in the draft Decree guiding the implementation of the new Law on Environmental Protection 2020 in

3.  TASKS & DELIVERABLES

3.1  Detailed tasks

  The selected consultant should perform the following tasks:
  • Synthesize international policies on investment and support for the development of environmental industry;
  • Review experience of countries around the world in developing the market for environmental goods in trade agreements, list of technologies, products, goods and services of environmental industry sector, and the type of projects associated with environmental industry;
  • Point out lessons learnt for Vietnam and suggestions for the development of environmental industry based on the output of reviewing international experiences;
  • Participate in in-depth consultative meetings and workshops with national experts and relevant stakeholders (MONRE, ISPONRE, HSF, etc);
  • Provide proposals and recommendations for the drafting process of the Decree including development of environmental industry sector, the list of environmental goods, services and the market for environmental goods in trade agreements;
  • Undertake Regulatory Impact Assessment of the environmental industry on the Decree;
  • Assist and support the national experts and ISPONRE in the tasks assigned to them – based on the technical needs articulated by them;

3.2  Final deliverables

  The international consultant is expected to submit:
  • A sub-report in English which includes the followings:
    • International policies on investment and support for environmental industry
   
  • International experience in developing the market for environmental goods in trade agreements, and list of technologies, products, goods, services and projects related to environmental industry sector
  • Proposal on policy recommendations to support the development of environmental industry in Vietnam in the Guiding decree of LEP 2020
  • recommendations for the provisions on the development of environmental industry sector in the Guiding Decree of LEP 2020;
  • Tailor-made presentations for consultative meetings and workshops
 

4.  SCOPE, TIMELINE and REMUNERATION PACKAGE

  1. The contract covers a maximum of 30 full working
  2. Renumeration is subject to qualifications and experience but capped to a maximum of 550 USD per day.

5.  QUALIFICATION AND EXPERIENCE REQUIREMENTS

Education:
